What the title covers

Supporting lawyers and the matters they handle. At some employers this is identical to paralegal work, including drafting, research, discovery and filings. At others it means calendaring, correspondence, maintaining files, client intake, entering billable time and arranging travel. Both are genuine jobs that firms depend on. They have different ceilings, they build different skills, and they are advertised under the same two words, which is why this entry exists.

A second use of this title

Same title, sometimes reversed

Most commonly, paralegal describes the substantive role and legal assistant the supporting one. But a meaningful number of firms use them the other way round, with legal assistant as the senior title and paralegal for junior staff, and a few use them interchangeably with no distinction at all. There is no governing body enforcing either usage, so the words on the posting genuinely do not settle it.

Because the title cannot tell you, ask directly. What share of this role is drafting and research. Who handles the calendar and the billing entries. Is this position billed to clients at an hourly rate, which is the clearest single indicator that the work is treated as substantive. Those three questions are entirely reasonable in an interview and will tell you more than the job description did.

Ask what the attorney is looking for before you start reading, because a summary written for cross examination and one written for a settlement conversation are different documents.

Summarise by topic rather than in the order the questions were asked, since depositions wander and the transcript order is rarely the useful order.

Give every point a page and line reference, because a summary the attorney cannot verify in ten seconds will not be used.

Mark the passages where the witness contradicted themselves or changed an earlier answer, as those are what the call is likely to be about.

Note where the witness said they did not know or could not recall, which matters as much as what they did say.

Index the exhibits against the pages where each was discussed, so the two documents work together rather than separately.

Send it in a form that can be read on a phone, because eight o'clock calls are frequently taken in a car.

One occupation, two different ceilings
